Privacy Policy

This Privacy Policy explains how Radiuschat (“Radiuschat,” “we,” “us,” or “our”) collects, uses, stores, and discloses information when you use the Radiuschat mobile application and the website at https://radiuschat.com (together, the “Service”). It also explains your privacy rights and how you can exercise them.

1. Who We Are

Radiuschat is the controller responsible for the processing described in this Privacy Policy.

2. What Radiuschat Does

Radiuschat is a location-based messaging service. It displays temporary geographic chat areas (“radiuses”) on a map.

When your device is located inside a radius, you may view and participate in that radius’s chat. Users may create radiuses, exchange messages, reply to and mention other participants, upload images, pin messages where authorized, and report radiuses or messages.

Messages are shared with participants of the relevant radius. Do not submit information that you do not want other participants to see.

3. Information We Collect

Account and profile information

When you create or update an account, we may collect:

  • Your username;
  • An optional profile biography;
  • A profile image (avatar), which you may upload or receive from your sign-in provider where available;
  • Your first name and last name, when provided through sign-in or by you;
  • Your email address, when provided through sign-in;
  • Your sign-in provider and its account identifier, where applicable;
  • An internally generated user ID;
  • Account creation and last-active timestamps;
  • Account status and related technical records.

Radiuschat supports both temporary accounts and permanent accounts. You can use a temporary account without providing an email address, first name, or last name. You can create a permanent account using Sign in with Google on Android or Sign in with Apple on iOS.

Information from Google and Apple sign-in

When you choose a sign-in provider, we receive and store the account and profile information it makes available based on your choices and the provider’s settings. Google may provide your first name, last name, email address, and profile image or image URL. Apple may provide your first name, last name, and email address; Sign in with Apple does not provide a profile image. If you choose Apple’s Hide My Email option, we receive and store the private relay email address instead of your personal email address.

We also process the provider’s account identifier and authentication information needed to verify your sign-in and recognize your permanent account on later visits. Your Google or Apple password is not shared with Radiuschat.

Location information

With your permission, the mobile application accesses your device’s approximate and precise location while you use the app.

We use location information to:

  • Show your position on the map;
  • Identify radiuses that contain your current position;
  • Make the corresponding local chats available;
  • Position a radius that you choose to create;
  • Prevent access to location-dependent features when you are outside the relevant area.

Radiuschat does not need background location access for these features. You can disable location permission in your device settings, but map positioning, radius creation, and local chats may then be unavailable or limited.

Radiuses and messages

When you use the messaging and radius features, we collect and process:

  • Radius name, description, geographic coordinates, size, color, image, owner ID, creation time, and expiration time;
  • Message text, message ID, radius ID, user ID, username snapshot, profile image URL, and creation time;
  • Images and other supported attachments uploaded with messages;
  • Replies, including a snapshot of the referenced message or attachment;
  • Resolved mentions of other participants;
  • Message pinning status;
  • Message and radius deletion or update events.

This content is user-generated and is visible to other users as necessary to provide the relevant radius and chat.

A radius owner may have additional moderation controls, such as pinning messages or deleting messages within that radius.

Reports and moderation information

If you report a radius or message, we collect:

  • The selected report reason;
  • Optional report details;
  • Your user ID;
  • Identifiers for the reported content;
  • Relevant content snapshots;
  • Report timestamps.

Reports are private and are used for safety, moderation, fraud prevention, dispute handling, and enforcement of our Terms of Use.

Images and files

If you choose to upload a profile image, radius image, or chat attachment, the application accesses only the image or file you select through the device picker.

Uploaded files are stored using our object-storage provider and made available through a file URL so that they can be displayed within the Service.

Device and technical information

We may automatically collect:

  • A randomly generated Radiuschat device identifier stored securely on your device;
  • Your Internet Protocol address;
  • Device type and operating system;
  • Application version and language;
  • Request timestamps;
  • Network and WebSocket connection information;
  • Server logs, error information, and diagnostic data;
  • Security and abuse-prevention signals.

The Radiuschat device identifier is generated by the app and sent when an account is created. It is used for security, abuse prevention, and device-level account controls. We do not use it as an advertising identifier.

Information stored locally

The app may store the following information on your device:

  • Your user ID;
  • Your Radiuschat device identifier;
  • Your selected language;
  • Authentication state;
  • Local unread-message information.

Some of this information is stored using secure device storage.

You can remove local information by deleting the app. Deleting the app does not automatically delete information stored on our servers.

4. How We Use Information

We use information to:

  • Create and manage temporary and permanent accounts and profiles;
  • Verify Google or Apple sign-in, associate it with your Radiuschat account, and enable you to sign in again;
  • Use names, email addresses, and avatars received during sign-in to maintain your account and populate available profile fields;
  • Provide maps, location-based radiuses, and local chats;
  • Deliver messages and real-time updates through WebSocket connections;
  • Upload and display profile images, radius images, and message attachments;
  • Show replies, mentions, pinned messages, and unread-message indicators;
  • Process account, radius, message, and profile changes;
  • Investigate reports and moderate user-generated content;
  • Protect users and the Service against spam, fraud, misuse, and security threats;
  • Diagnose errors and maintain the reliability of the Service;
  • Improve the Service;
  • Comply with legal obligations and respond to lawful requests;
  • Establish, exercise, or defend legal claims.

We do not sell your personal data.

We do not use precise location, messages, or attachments for targeted advertising.

5. Legal Bases for Processing

Where the General Data Protection Regulation (“GDPR”) or similar law applies, we rely on the following legal bases:

Performance of a contract

We process information as necessary to create your temporary or permanent account, authenticate you through your chosen sign-in provider, and provide the messaging, map, radius, upload, and profile features you request.

Consent

We rely on your consent to access device location and selected photos or files when device permissions or applicable law require consent.

You may withdraw permission through your device settings. Withdrawing permission does not affect processing that occurred before the permission was withdrawn.

Legitimate interests

We may process information where necessary to:

  • Secure and operate the Service;
  • Prevent fraud, spam, and abuse;
  • Maintain reliability;
  • Diagnose technical failures;
  • Moderate content;
  • Protect Radiuschat and its users.

We rely on these interests only when they are not overridden by your rights and interests.

Legal obligations

We may process information when required to comply with applicable law or a valid legal request.

Legal claims and user protection

We may process information when necessary to investigate harmful conduct or to establish, exercise, or defend legal claims.

6. How Information Is Disclosed

Other Radiuschat users

The following information may be visible to other users:

  • Your username;
  • Your profile image;
  • Your profile biography where displayed;
  • Radiuses you create, including their names, descriptions, images, and settings;
  • Messages and attachments you submit;
  • Replies and mentions;
  • Other public chat activity.

Your precise device location is not intentionally displayed to other users.

However, participating in a geographically restricted chat may allow other users to infer that you are or were located within that radius.

Service providers

We may disclose information to vendors that process it on our behalf, including providers of:

  • Cloud infrastructure;
  • Databases and server hosting;
  • Network infrastructure;
  • Object storage and content delivery;
  • Map rendering and location-related services, including Mapbox;
  • Application distribution, including Google Play and the Apple App Store;
  • Security, diagnostics, customer support, and operational services.

These providers may receive information necessary to perform their services, such as:

  • IP addresses;
  • Device and request information;
  • Map interactions;
  • Location-related information;
  • Uploaded images and attachments.

Their processing may also be subject to their own privacy policies where they act independently.

Sign-in providers

If you choose Sign in with Google on Android or Sign in with Apple on iOS, we exchange the authentication information needed to complete sign-in with that provider. Google and Apple process information about your use of their sign-in services under their own terms and privacy policies. See the Google Privacy Policy and Sign in with Apple & Privacy notice.

Legal and safety disclosures

We may disclose information when reasonably necessary to:

  • Comply with applicable law or legal process;
  • Enforce our agreements;
  • Investigate fraud, abuse, or security incidents;
  • Protect Radiuschat users or the public;
  • Protect our rights and property.

Business transfers

Information may be transferred as part of a merger, financing, reorganization, acquisition, insolvency, or sale of all or part of the Service.

We will provide notice where required by law.

We may also disclose information when you instruct us to do so or otherwise provide valid consent.

7. Data Retention

We retain information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing the Service, maintaining security, resolving disputes, enforcing agreements, and complying with legal obligations.

In particular:

  • Permanent account information, including names, email addresses, avatars, and sign-in identifiers where provided, is retained while your account remains active and as otherwise necessary for the purposes above, subject to the deletion provisions below;
  • Temporary account information is also subject to these retention and deletion provisions; losing access to a temporary account does not itself delete its server-side data;
  • Active radiuses normally expire after the period shown in the app;
  • Server logs and technical records are retained according to our operational and security retention schedules;
  • Uploaded files may remain available while referenced by active Service content and for a limited backup or deletion-processing period afterward;
  • Moderation reports and relevant content snapshots may be retained after the original radius, message, or account is deleted when reasonably necessary to investigate abuse, prevent repeated reports, protect users, comply with legal obligations, or establish or defend legal claims;
  • Backup copies may remain for a limited period until they are overwritten or securely deleted.

We may retain anonymized information that can no longer reasonably be connected to an identifiable individual.

8. Account and Data Deletion

You can delete your temporary or permanent profile from the Settings page in the Radiuschat application.

Deletion requests cover account and profile information, including stored first and last names, email addresses, avatars, and sign-in identifiers, subject to the retention exceptions described below.

Signing out or uninstalling the app does not delete your permanent account. Deleting your Radiuschat account does not delete your Google or Apple account. You can manage the sign-in connection in your provider’s settings; to request deletion of data held by Radiuschat, use the account deletion process described here.

You may also contact info@radiuschat.com to request access, correction, or deletion of your personal data.

Deleting your account invalidates your user ID and prevents that account from authenticating again.

Existing radiuses may remain until their normal expiration. Existing messages may retain the username and content snapshot that was shared at the time of posting so that conversations remain understandable.

Moderation records may also be retained as described in the Data Retention section.

Where continued identification is unnecessary, we may delete or anonymize identifying information while retaining non-identifying content.

We may retain information when required by law or where another valid legal basis applies, including for:

  • Security and abuse prevention;
  • Unresolved reports;
  • Compliance with legal obligations;
  • Establishing or defending legal claims.

When complete deletion is not possible, we will restrict retained information to the permitted purpose.

9. International Data Transfers

Your information may be processed in Poland, elsewhere in the European Economic Area, or in other countries where our service providers operate.

If personal data is transferred outside the European Economic Area to a country that does not benefit from an adequacy decision, we use an applicable transfer mechanism, such as the European Commission’s Standard Contractual Clauses, together with supplementary safeguards where required.

10. Security

We use reasonable technical and organizational measures designed to protect personal data, including:

  • Encrypted network transport;
  • Access controls;
  • Secure device storage for certain local identifiers;
  • Restricted upload mechanisms;
  • Operational and security monitoring.

No transmission or storage system is completely secure, and we cannot guarantee absolute security.

Radius chats should not be treated as private or end-to-end encrypted communications unless the application expressly states otherwise.

Do not share passwords, payment information, government identifiers, exact home addresses, or other highly sensitive information in messages.

11. Your Privacy Rights

Depending on your location, you may have the right to:

  • Access personal data we hold about you;
  • Correct inaccurate or incomplete information;
  • Request deletion of your personal data;
  • Restrict certain processing;
  • Object to certain processing;
  • Receive certain data in a portable format;
  • Withdraw consent at any time;
  • Lodge a complaint with a competent data-protection authority.

Withdrawing consent does not affect the lawfulness of processing performed before consent was withdrawn.

In Poland, the supervisory authority is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, UODO).

12. Children’s Privacy

Radiuschat is not directed to children under 13, and children under 13 must not use the Service, even with parental permission. A higher minimum age applies where required by applicable law or platform restrictions. This applies to temporary accounts and permanent accounts created through Google or Apple.

Eligible users under 18, or otherwise below the age of legal adulthood where they live, must have a parent’s or legal guardian’s permission and supervision. Parents and guardians should review this policy with the minor and supervise their chat activity, profile information, image sharing, location permissions, and interactions with other users. Local chat participation may reveal a minor’s approximate location.

In the European Economic Area, where we rely on consent to process personal data in connection with an online service offered directly to a child, the age at which the child can consent independently varies from 13 to 16 under national law. Below the applicable threshold, consent must be given or authorized by a parent or legal guardian, and reasonable efforts must be made to verify that authorization. This is separate from permission to use the app or device permissions. Where required authorization cannot be obtained and verified, the relevant processing must not take place.

In the United States, the Children’s Online Privacy Protection Act (COPPA) provides protections for personal information of children under 13. We do not knowingly collect personal data from children under 13. Other applicable laws may provide additional protections or impose consent or access requirements for teenagers; the 13-year minimum does not override those requirements.

A Google or Apple sign-in, an app-store age rating, or a device permission does not by itself verify age or establish legally required parental consent.

If you believe an underage child is using Radiuschat or that we have collected a child’s personal data without required authorization, contact info@radiuschat.com. We will investigate and, if confirmed, take appropriate steps to restrict access and delete the personal data, except where retention is legally required. Parents or legal guardians may also contact us to request access, correction, or deletion of their child’s information, subject to verification of their identity and authority.

13. Third-Party Links

Messages may contain links to third-party websites.

Radiuschat does not control these websites and is not responsible for their content, security, or privacy practices.

You should review the privacy policy of a third-party service before providing information to it.

14. Changes to This Privacy Policy

We may update this Privacy Policy when the Service, our data practices, or applicable legal requirements change.

We will publish the revised Privacy Policy at the same public URL and update the “Last updated” date.

Where required, we will provide an additional notice in the application or request consent before materially different processing begins.
