Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Radiuschat mobile application, the website at https://radiuschat.com, and any related services provided by Radiuschat (collectively, the “Service”).

By creating an account, selecting the acceptance checkbox, accessing the Service, or using the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

1. Service Provider

2. Description of the Service

Radiuschat is a location-based messaging service.

The Service allows users to:

  • View temporary geographic chat areas (“radiuses”) on a map;
  • Create radiuses with a name, description, and other settings at their current location;
  • Join chats associated with radiuses that contain their current location;
  • Send messages and attachments;
  • Reply to and mention other users;
  • Pin messages where authorized;
  • Manage radiuses they own;
  • Report radiuses and messages;
  • Create and manage a user profile.

Access to some features requires location permission and a supported mobile device.

Radiuses are temporary and may automatically expire after the period displayed in the application.

3. Eligibility

You must be at least 13 years old to use Radiuschat. Children under 13 must not use the Service, even with parental permission. If applicable law or a platform restriction requires a higher minimum age, you must meet that higher age. These requirements apply to both temporary accounts and permanent accounts, including accounts created through Google or Apple.

If you are under 18, or otherwise below the age of legal adulthood where you live, you may use the Service only where permitted by law and with the permission and supervision of a parent or legal guardian. Your parent or guardian should review these Terms and our Privacy Policy with you.

Parents and guardians who permit an eligible minor to use Radiuschat must supervise their use, including their chat activity, shared images and profile information, location permissions, and interactions with other users. Discuss online safety, discourage sharing identifying or sensitive information, and help the minor report inappropriate content or contact. Participation in a local chat may reveal the minor’s approximate location. Parental supervision does not replace Radiuschat’s own safety and privacy obligations.

Where applicable law requires parental authorization for processing a minor’s personal data, that authorization must be obtained and verified as required before the relevant processing takes place. If a required consent or age requirement cannot be satisfied, the minor must not use the affected features or Service. Parental permission cannot override a legal or platform prohibition on access by minors.

An app-store content rating describes content suitability; it does not replace these eligibility requirements. Signing in with Google or Apple does not by itself establish that you meet our minimum age or that any required parental permission has been obtained.

By using the Service, you confirm that:

  • You meet the applicable minimum age requirement;
  • You can legally agree to these Terms or have the required authorization from your parent or legal guardian;
  • Your use of the Service is permitted under applicable law and platform restrictions;
  • You are not prohibited from using the Service.

4. Accounts

Some features require an account. Radiuschat supports temporary accounts and permanent accounts created using Sign in with Google on Android or Sign in with Apple on iOS.

You agree to:

  • Provide information that is accurate and not misleading;
  • Keep your device and account access secure;
  • Notify us if you believe your account has been accessed without authorization;
  • Accept responsibility for activity performed through your account or device.

You must not:

  • Impersonate another person or organization;
  • Use a username that infringes another person’s rights;
  • Use a username that is unlawful, threatening, hateful, sexually explicit, or otherwise seriously inappropriate;
  • Create accounts through automated means;
  • Sell, transfer, or share access to your account.

We may remove or change a username if reasonably necessary to protect users, comply with law, prevent impersonation, or enforce these Terms.

Permanent accounts through Google or Apple

You may use Sign in with Google on Android or Sign in with Apple on iOS to create a permanent Radiuschat account and sign in to it again. We store the information made available through your chosen provider, which may include your first name, last name, email address, avatar where available, and provider account identifier, as explained in our Privacy Policy. Apple may provide a private relay email address if you choose Hide My Email; Sign in with Apple does not provide an avatar.

You are responsible for keeping your Google or Apple account secure. Access to your permanent Radiuschat account depends on continued access to the associated sign-in provider account and the availability of that provider’s sign-in service. Signing out or deleting the app does not by itself delete a permanent account. A permanent account does not guarantee indefinite availability of the Service or indefinite retention of messages or radiuses; the expiration, deletion, and termination provisions in these Terms still apply.

Temporary accounts

Radiuschat may provide temporary accounts that are associated with a locally stored user identifier rather than a password, email address, or telephone number.

Temporary accounts may not be recoverable. You may permanently lose access to your account if you:

  • Log out;
  • Delete the application;
  • Clear the application’s data;
  • Delete your profile;
  • Lose or replace your device;
  • Lose the locally stored account identifier.

You are responsible for understanding this limitation before creating content through a temporary account.

5. Location-Based Access

Radiuschat uses your device location to determine which radiuses and chats are available to you.

You understand that:

  • Device location information may be inaccurate, delayed, or unavailable;
  • Radius boundaries displayed on the map are approximate;
  • Map information may not reflect real-world conditions;
  • Access to a chat does not guarantee that every participant is physically present within the radius at the same time;
  • Other users may infer that you are or were within a geographic area based on your participation in its chat.

You must not use Radiuschat as an emergency, navigation, rescue, personal safety, or location-verification service.

Do not rely on Radiuschat to contact emergency services. In an emergency, contact the appropriate local emergency service directly.

6. User Content

“User Content” means information or material submitted, uploaded, created, or shared through the Service, including:

  • Usernames and profile biographies;
  • Profile and radius images;
  • Radius names, descriptions, and settings;
  • Messages;
  • Replies and mentions;
  • Images and attachments;
  • Reports and report details.

You retain ownership of your User Content.

You are responsible for your User Content and for ensuring that you have all rights and permissions necessary to submit it.

Licence granted to Radiuschat

By submitting User Content, you grant Radiuschat a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit, display, format, and distribute that User Content only as reasonably necessary to:

  • Operate and provide the Service;
  • Display content to relevant users;
  • Deliver messages and attachments;
  • Maintain backups;
  • Moderate content;
  • Investigate reports;
  • Protect users and the Service;
  • Comply with legal obligations.

This licence does not transfer ownership of your User Content to Radiuschat.

The licence ends when the User Content is deleted from our active systems, except where continued retention is reasonably necessary for backups, moderation, security, legal compliance, dispute resolution, or legal claims.

7. Visibility of Messages and Location Inferences

Messages in radius chats are not private communications between you and Radiuschat.

Your messages, username, profile image, replies, mentions, and attachments may be visible to other participants in the relevant radius.

Radiuschat chats should not be considered end-to-end encrypted unless the application expressly states otherwise.

You should not submit:

  • Passwords;
  • Payment information;
  • Government identification numbers;
  • Exact home addresses;
  • Private medical information;
  • Other highly sensitive or confidential information.

Although Radiuschat does not intentionally display your precise device location to other users, participation in a radius may reveal or allow others to infer your approximate location.

8. Content Standards

You must not use Radiuschat to create, upload, share, promote, or distribute content that:

  • Is illegal or promotes illegal activity;
  • Threatens, harasses, stalks, intimidates, or abuses another person;
  • Promotes violence or credible threats of harm;
  • Contains hate speech or unlawfully discriminates against protected groups;
  • Sexually exploits or endangers children;
  • Contains child sexual abuse material;
  • Is pornographic or sexually exploitative;
  • Violates another person’s privacy or publicity rights;
  • Discloses another person’s sensitive personal information without permission;
  • Is defamatory or knowingly false in a harmful way;
  • Infringes copyright, trademark, or other intellectual property rights;
  • Contains malware, viruses, spyware, or harmful code;
  • Constitutes spam, unauthorized advertising, or repetitive unsolicited content;
  • Impersonates another person or misrepresents its source;
  • Facilitates fraud, scams, phishing, or deceptive conduct;
  • Interferes with the safety or operation of the Service;
  • Otherwise violates applicable law or these Terms.

You must not use the Service to arrange, encourage, or participate in conduct that creates a serious risk to another person’s safety.

9. Prohibited Technical Conduct

You must not:

  • Access the Service through unauthorized automated systems, bots, scripts, or scrapers;
  • Create accounts or send messages automatically without our written permission;
  • Attempt to gain unauthorized access to accounts, servers, databases, or networks;
  • Circumvent access controls, rate limits, geographic restrictions, or security measures;
  • Probe, scan, or test the vulnerability of the Service without authorization;
  • Interfere with or place an unreasonable burden on the Service;
  • Introduce malware or harmful code;
  • Collect information about other users without authorization;
  • Reverse engineer the Service except where applicable law expressly permits it;
  • Use the Service or its data to create a competing database or service;
  • Use Radiuschat identifiers or APIs in an unauthorized manner.

We may apply technical limits to protect the Service, including limits on active radiuses, message size, attachments, reports, requests, and account creation.

10. Radius Ownership and Administration

A user who creates a radius may receive administrative functionality for that radius.

Depending on the available features, a radius owner may be able to:

  • Change the radius name, description, image, size, or color;
  • Pin or unpin messages;
  • Delete messages;
  • Delete the radius;
  • Access other management controls.

Radius owners must use these controls fairly and in compliance with these Terms.

A radius owner is not an employee, representative, agent, or official moderator of Radiuschat. Radiuschat is not responsible for a radius owner’s statements or conduct.

Administrative controls do not create ownership rights over the Service, other users, or their content.

11. Reports and Content Moderation

Users may report radiuses or messages for reasons including spam, harassment, inappropriate content, illegal content, or other violations.

You must not knowingly submit false, misleading, abusive, or repetitive reports.

We may review reports and User Content to enforce these Terms and protect the Service. Depending on the circumstances, we may:

  • Remove or restrict content;
  • Delete messages or attachments;
  • Restrict or delete radiuses;
  • Change or remove usernames;
  • Limit application features;
  • Suspend or terminate accounts;
  • Block devices, user identifiers, or IP addresses;
  • Preserve relevant evidence;
  • Notify law enforcement or another competent authority where appropriate or legally required.

We may use automated tools and human review to detect technical abuse and evaluate reported content. Automated systems may make mistakes.

Where required by applicable law, we will provide information about significant moderation decisions and available methods of appeal.

To question a moderation decision, contact legal@radiuschat.com and include enough information to identify the relevant account, radius, message, or decision.

We do not guarantee that all prohibited content will be identified or removed immediately.

12. Content Deletion and Expiration

Radiuses may expire automatically after the period displayed in the Service.

Deleting an account, radius, or message may not immediately remove every copy from:

  • Backups;
  • Cached systems;
  • Moderation records;
  • Security logs;
  • Legal records;
  • Content snapshots used in replies or reports.

A reply may retain a snapshot of an original message or attachment even when the original is no longer available.

Existing messages may retain the username and content snapshot recorded when the message was posted. Additional information about retention and deletion is provided in our Privacy Policy.

13. Intellectual Property

Except for User Content, the Service and its components are owned by or licensed to Radiuschat, including:

  • Software and source code;
  • Designs and interfaces;
  • Databases and service structure;
  • Text and graphics;
  • Logos and trademarks;
  • Radiuschat branding.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Radiuschat application on devices you own or control.

This licence is solely for lawful, personal use of the Service.

You may not copy, sell, license, distribute, modify, or commercially exploit Radiuschat’s intellectual property except with our written permission or where applicable law expressly permits it.

14. Copyright Complaints

If you believe that content available through Radiuschat infringes your copyright or other intellectual property rights, contact:

Your notice should include:

  • Identification of the protected work;
  • Identification of the allegedly infringing content;
  • Information sufficient for us to locate the content;
  • Your contact information;
  • A statement explaining why you believe the use is unauthorized;
  • Confirmation that the information in your notice is accurate;
  • Confirmation that you are the rights holder or authorized to act for the rights holder.

We may request additional information before acting on a complaint.

Knowingly submitting a false intellectual property complaint may result in account restrictions and legal liability.

15. Third-Party Services

Radiuschat uses or interacts with third-party services, which may include:

  • Map and location services, including Mapbox;
  • Cloud hosting and object storage;
  • Google Play and Sign in with Google;
  • Apple App Store and Sign in with Apple;
  • Device operating-system services;
  • Websites linked in user messages.

Third-party services are governed by their own terms and policies.

We are not responsible for third-party websites, content, services, availability, or privacy practices. A link or integration does not necessarily mean that Radiuschat endorses the third party.

16. Application Stores

If you download Radiuschat through Google Play or the Apple App Store, you must also comply with the applicable store’s terms.

Google and Apple are not responsible for operating or supporting Radiuschat except to the extent required by their own terms or applicable law.

Where required by the applicable store terms, Google or Apple may be a third-party beneficiary of the provisions relating to your licence to use the application.

17. Privacy

Our Privacy Policy explains how we collect, use, store, disclose, and delete personal data.

The Privacy Policy forms part of these Terms and is available at: https://radiuschat.com/privacy-policy

By using the Service, you acknowledge that you have reviewed the Privacy Policy.

Location access and selected media access remain subject to the permissions you grant through your device.

18. Account Deletion

You may delete your temporary or permanent profile through the Settings page in the application.

Deleting a Radiuschat account does not delete the Google or Apple account used to sign in. Managing or revoking a provider connection is separate from requesting deletion of your Radiuschat account and its data.

Account deletion is permanent. After deleting your account:

  • Your user ID can no longer authenticate;
  • You will not be able to restore or sign in to the deleted account;
  • Existing radiuses may remain until their scheduled expiration;
  • Existing message and moderation snapshots may be retained as described in the Privacy Policy.

Deleting the Radiuschat application from your device does not automatically delete your server-side account or User Content.

19. Suspension and Termination

You may stop using the Service at any time.

We may restrict, suspend, or terminate access when reasonably necessary because:

  • You violated these Terms;
  • Your activity creates a security or safety risk;
  • Your account is involved in spam, fraud, or abuse;
  • We are required to act by law or a competent authority;
  • Continuing to provide the Service is no longer technically or commercially feasible.

Where reasonably possible and legally required, we will provide notice and an explanation.

Serious or urgent violations may require immediate action without advance notice.

Termination does not affect provisions that reasonably need to continue, including provisions relating to intellectual property, content licences, retained moderation records, liability, disputes, and legal compliance.

20. Availability and Changes to the Service

We aim to keep Radiuschat available, but we do not guarantee uninterrupted or error-free operation.

The Service may be unavailable because of:

  • Maintenance;
  • Network problems;
  • Software or hardware failures;
  • Third-party service failures;
  • Security incidents;
  • Legal or regulatory requirements;
  • Events outside our reasonable control.

We may add, change, restrict, suspend, or discontinue features.

If a change materially reduces a core part of an ongoing digital service, we will provide notice or remedies where required by applicable consumer law.

21. No Professional or Emergency Service

Radiuschat does not provide:

  • Emergency assistance;
  • Law-enforcement services;
  • Medical, legal, or financial advice;
  • Guaranteed identity verification;
  • Guaranteed location verification;
  • Background checks on users.

You are responsible for evaluating interactions with other users and taking appropriate precautions.

If you meet another user in person, consider doing so in a public place and telling someone you trust.

22. Disclaimers

To the extent permitted by law, the Service is provided on an “as available” basis.

We do not guarantee that:

  • The Service will always be available;
  • Location or map information will always be accurate;
  • Every user is physically located where expected;
  • Messages will always be delivered immediately;
  • Content will always remain available;
  • Every user will comply with these Terms;
  • All harmful content will be detected or removed;
  • The Service will be free from errors or security incidents.

Nothing in these Terms excludes warranties, remedies, or other rights that cannot legally be excluded under applicable consumer law.

23. Limitation of Liability

Nothing in these Terms limits or excludes liability where doing so is prohibited by law, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, fraud, or violation of mandatory consumer rights.

To the extent permitted by applicable law, Radiuschat is not responsible for indirect or unforeseeable losses resulting from:

  • Your misuse of the Service;
  • User Content submitted by other users;
  • Interactions between users;
  • Inaccurate device location or map information;
  • Third-party websites or services;
  • Temporary interruptions outside our reasonable control;
  • Loss of access to a temporary account caused by deleting local credentials, logging out, deleting the application, or losing the device.

These limitations do not affect rights that you cannot waive under the law of your country.

24. Responsibility for Violations

You are responsible for losses reasonably incurred by Radiuschat or another person as a direct result of your intentional or unlawful violation of these Terms or another person’s rights.

This provision does not require consumers to compensate Radiuschat for losses that were not reasonably foreseeable or that resulted from Radiuschat’s own conduct.

25. Governing Law and Disputes

These Terms are governed by the laws of Poland, without depriving consumers of mandatory protections provided by the law of the country in which they normally reside.

Before starting formal proceedings, you may contact legal@radiuschat.com so that we can attempt to resolve the matter informally.

Nothing in these Terms prevents a consumer from bringing a claim before a court that has jurisdiction under applicable consumer law.

These Terms do not require consumers to submit disputes exclusively to private arbitration.

26. Changes to These Terms

We may update these Terms when:

  • The Service or its features change;
  • We introduce new safety or moderation rules;
  • Applicable laws or platform requirements change;
  • Changes are necessary to address security or abuse;
  • Clarifications are reasonably required.

We will publish the updated Terms and change the “Last updated” date.

Where required by law, we will provide reasonable advance notice of material changes. If a material change requires your consent, we will request it before the change applies to you.

27. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful and enforceable.

28. No Waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

29. Entire Agreement

These Terms, together with the Privacy Policy and any additional rules clearly presented for a specific feature, constitute the agreement between you and Radiuschat concerning the Service.
